ArtizIQ LLC ("we," "our," or "us") is a limited liability company organized under the laws of the State of Texas, United States, with its principal place of business in Houston, Texas. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our services.
We process personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation ("GDPR") and the UK GDPR where we offer goods or services to, or monitor the behaviour of, individuals in those territories, and the California Consumer Privacy Act, as amended by the CPRA ("CCPA"), for California residents.
Information We Collect
We may collect information about you in various ways, including:
- Personal Data: Name, email address, phone number, shipping address, and billing information when you create an account or place an order.
- Payment Information: Credit card details and billing address (processed securely through our payment processor, Stripe).
- Usage Data: Information about how you interact with our website, including IP address, browser type, and pages visited.
- Design Files: Images and designs you upload for printing or customization purposes.
How We Use Your Information
We use the information we collect to:
- Process and fulfill your orders
- Communicate with you about your orders and our services
- Improve our website and services
- Send promotional communications (with your consent)
- Comply with legal obligations
Legal Bases for Processing
Where the GDPR or UK GDPR applies, we rely on the following legal bases: contract (to provide the platform, create accounts, route orders, and process payouts); legal obligation (accounting, tax, anti-money-laundering, sanctions, and e-commerce record-keeping); legitimate interests (to secure the platform, prevent fraud and abuse, enforce our Terms, and improve the product); and consent (non-essential cookies and optional marketing, which you may withdraw at any time).
Information Sharing
We may share your information with the following categories of third parties:
- Payment Processors: Stripe (payments, fraud detection) and Plaid (identity verification, bank connections).
- Shipping & Fulfillment: Shippo (shipping label generation, address validation, rate shopping) and its carrier network including USPS, UPS, FedEx, DHL and 85+ additional carriers. Data shared with Shippo includes recipient name, shipping address, phone number, and parcel details. See privacy.goshippo.com.
- Connected Marketplaces: When you connect a third-party marketplace (Etsy, Shopify, TikTok Shop, Amazon), we exchange listing, order, and fulfillment data with that marketplace solely to provide the services you request. See each marketplace's own privacy policy: Etsy, Shopify, TikTok.
- Cloud Infrastructure: AWS and similar hosting providers under written data processing agreements.
- Legal Requirements: When required by law or to protect our rights.
We do not sell your personal information to third parties.
Marketplace Integrations
When you connect a third-party marketplace account to ArtizIQ, we act as a service provider to you (the seller). We process marketplace data solely to fulfill the artisan production and fulfillment services you request and do not use this data for advertising or unrelated purposes.
Etsy Integration Notice: The term "Etsy" is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc. With respect to any personal information relating to Etsy Members that we access via the Etsy API, we acknowledge that we act as a service provider to you and will process such data only to fulfill the services that we provide.
Shopify Integration: We comply with Shopify's API License and Terms of Use, including the mandatory GDPR webhooks customers/data_request, customers/redact, and shop/redact. When you uninstall our application, your shop data is deleted or redacted within 48 hours except where retention is required by law.
Shopify Protected Customer Data: When a seller connects a Shopify store, we receive customer name, email, phone, and shipping address from the seller's orders. We use this data only for (a) order management within ArtizIQ, (b) coordination with the artisan responsible for production, and (c) fulfillment and shipping support (carrier labels, customs forms, delivery contact). We do not use this data for marketing, advertising, analytics, automated decision-making, recommendation, personalization, or AI/ML training. Customer data is not sold or shared with third parties except sub-processors strictly necessary to fulfill these purposes (carriers, payment processors, hosting providers — listed in our Data Processing Agreement). Customers may exercise their data subject rights (access, rectification, erasure, restriction, portability, objection) by contacting the seller, who can then submit a deletion or data-export request to ArtizIQ via admin@artiziq.com or via the Shopify customers/data_request / customers/redact webhook.
TikTok Shop Integration: We comply with TikTok Shop Partner requirements including content moderation, data security review, and prompt deletion when data sharing authorization is revoked.
AI and Machine Learning
ArtizIQ does not use merchant or customer data obtained via marketplace APIs (Etsy, Shopify, TikTok Shop, Amazon) to train artificial intelligence or machine learning models. Any future use of such data for AI/ML training will require explicit written consent from the respective merchant.
International Data Transfers
The platform is operated from the United States, and we use subprocessors located in the United States, the European Economic Area, and the United Kingdom. Where we transfer personal data from the EEA or the UK to a country that is not the subject of an adequacy decision, we rely on appropriate safeguards — principally the European Commission's Standard Contractual Clauses (2021/914) with any required supplementary measures, the UK International Data Transfer Addendum, and, where applicable, our certification under the EU-U.S. Data Privacy Framework and its UK extension. You may request a copy of the transfer safeguards applicable to your data by writing to the contact address below.
Data Retention
We retain personal data only as long as needed for the purposes described above and as required by law. We distinguish between customer personal data — which we remove on a short timeline — and non-identifying financial and transaction records, which tax and accounting law requires us to keep for longer:
- Customer personal data within orders (the buyer's name, email, phone, street address and postal code, and any order notes): redacted thirty (30) days after the order is fulfilled or cancelled. After redaction we retain only the coarse shipping location (city, state/province, and country) alongside non-identifying order data. This redaction is permanent and cannot be undone.
- Order, financial, and invoicing records (after the 30-day redaction above, i.e. without direct customer identifiers): for the period required by applicable U.S. federal and state tax, accounting, and anti-fraud laws (generally up to seven (7) years, or longer where required by law).
Cookies and Tracking
We use essential cookies for authentication and session management. We may also use analytics cookies to understand how you use our platform. You can control cookie preferences through your browser settings.
We use Stripe for payment, analytics, and other business services. Stripe collects identifying information about the devices that connect to its services, including via cookies and similar technologies. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection, authentication, and analytics related to the performance of its services. Data Security
We implement appropriate technical and organizational measures to protect your personal information, as described on our Security page. However, no method of transmission over the Internet is 100% secure.
Your Rights
Subject to applicable law, you have the right to:
- Access and receive a copy of your personal data
- Correct inaccurate personal data
- Request deletion of your personal data
- Request restriction of, or object to, certain processing, and request data portability (EEA/UK)
- Opt-out of marketing communications
California residents additionally have the rights afforded by the CCPA, including the right to know, delete, and correct personal information and to opt out of any "sale" or "sharing" of personal information; we do not sell personal information. You may exercise these rights by writing to admin@artiziq.com. You also have the right to lodge a complaint with a supervisory or regulatory authority — in the EU, the authority of your country of residence; in the UK, the Information Commissioner's Office; and in the United States, the relevant state authority (for California, the California Privacy Protection Agency).
